{"id":10018,"date":"2011-01-14T15:20:42","date_gmt":"2011-01-14T15:20:42","guid":{"rendered":"https:\/\/www.nationaldebtrelief.co.uk\/debt-articles\/?p=10018"},"modified":"2019-06-27T15:26:46","modified_gmt":"2019-06-27T14:26:46","slug":"bankruptcy-adjournment","status":"publish","type":"post","link":"https:\/\/www.nationaldebtrelief.co.uk\/debt-articles\/bankruptcy-adjournment\/","title":{"rendered":"Bankruptcy Adjournment"},"content":{"rendered":"\n<p>Let us say that a creditor has a county court judgment against you  and that you cannot pay the debt and that you have been unable to reach  agreement with the creditor to pay it off over time. <\/p>\n\n\n\n<!--more-->\n\n\n\n<p>Let us also say  that the creditor has issued a bankruptcy petition and the bankruptcy  hearing is scheduled to take place in the next couple of days or weeks.  You would like to consider alternative options to bankruptcy such as an  Individual Voluntary Arrangement (IVA) but the court hearing is looming.  What can you do?<\/p>\n\n\n\n<figure class=\"wp-block-image\"><img loading=\"lazy\" decoding=\"async\" width=\"424\" height=\"283\" src=\"https:\/\/www.nationaldebtrelief.co.uk\/debt-articles\/wp-content\/uploads\/2019\/03\/Fotolia_6790790_XS.jpg\" alt=\"Bankruptcy Hearing\" class=\"wp-image-3931\" srcset=\"https:\/\/www.nationaldebtrelief.co.uk\/debt-articles\/wp-content\/uploads\/2019\/03\/Fotolia_6790790_XS.jpg 424w, https:\/\/www.nationaldebtrelief.co.uk\/debt-articles\/wp-content\/uploads\/2019\/03\/Fotolia_6790790_XS-300x200.jpg 300w\" sizes=\"auto, (max-width: 424px) 100vw, 424px\" \/><\/figure>\n\n\n\n<p>What you need is time and the way to buy some time is to ask the  judge for an adjournment of the bankruptcy hearing to allow an  insolvency practitioner (IP) to look at your case. Most judges will  grant such an adjournment. It would be nice to be able to say that all  judges would do so but because of the independence of the judiciary, it  would be presumptuous to claim that no judge would refuse such a  request. You may even have time before the bankruptcy hearing to  authorize an IP to act for you and to fax the court confirming the  appointment, if the judge so requires.<\/p>\n\n\n\n<p>Assuming you are granted the adjournment, you have time to consult \nwith an IP and to authorize him or her to act on your behalf. If an IVA \nis a suitable alternative option to bankruptcy, an IVA proposal can be \ndrafted and lodged in court in advance of the adjourned bankruptcy \nhearing.
