{"id":11018,"date":"2011-02-10T12:11:46","date_gmt":"2011-02-10T12:11:46","guid":{"rendered":"https:\/\/www.nationaldebtrelief.co.uk\/debt-articles\/?p=11018"},"modified":"2019-08-05T12:13:04","modified_gmt":"2019-08-05T11:13:04","slug":"debt-management-to-iva","status":"publish","type":"post","link":"https:\/\/www.nationaldebtrelief.co.uk\/debt-articles\/debt-management-to-iva\/","title":{"rendered":"Debt Management to IVA"},"content":{"rendered":"\n<p>Being in a Debt Management Plan (DMP) should not in itself prevent you  from offering proposals to your creditors for an Individual Voluntary  Arrangement (IVA).  <\/p>\n\n\n\n<!--more-->\n\n\n\n<p>If you are not insolvent the question does not arise, since under the  1986 Insolvency Act you have to be insolvent before you can enter an  IVA. Many people who are currently in DMPs are not insolvent, in spite  of the financial difficulties they may be encountering. The second  barrier to entering an IVA is that while this financial solution is  available in England, Wales and Northern Ireland, it is not available in  Scotland or the Republic of Ireland. In Scotland the financial solution  which is broadly equivalent to an IVA is a Trust Deed. For the Republic  of Ireland there is no financial solution remotely like an IVA although  legislation to introduce such a solution there has been in preparation  for several years now. Under European Regulations, it is entirely  possible for you to enter an IVA provided that you live in a member  state of the European Union and have your \u2018Centre of Main Interests\u2019 or  COMI in England, Scotland or Northern Ireland. <\/p>\n\n\n\n<figure class=\"wp-block-image\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"682\" src=\"https:\/\/www.nationaldebtrelief.co.uk\/debt-articles\/wp-content\/uploads\/2019\/08\/Fotolia_40064704_M-1024x682.jpg\" alt=\"Debt Management to IVA\" class=\"wp-image-11028\" srcset=\"https:\/\/www.nationaldebtrelief.co.uk\/debt-articles\/wp-content\/uploads\/2019\/08\/Fotolia_40064704_M-1024x682.jpg 1024w, https:\/\/www.nationaldebtrelief.co.uk\/debt-articles\/wp-content\/uploads\/2019\/08\/Fotolia_40064704_M-300x200.jpg 300w, https:\/\/www.nationaldebtrelief.co.uk\/debt-articles\/wp-content\/uploads\/2019\/08\/Fotolia_40064704_M-768x512.jpg 768w, https:\/\/www.nationaldebtrelief.co.uk\/debt-articles\/wp-content\/uploads\/2019\/08\/Fotolia_40064704_M.jpg 1688w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<p>While no official figures are available, it is estimated that there \nare almost one million people in the UK currently in DMPs. Some of these\n DMPs are self administered where the debtor reaches informal agreements\n with creditors to make reduced payments on unsecured debts. However, \nmost DMPs are administered by DMP providers who specialize in debt \nmanagement. If you want to check whether an IVA or indeed some other \nfinancial solution might be more appropriate for your circumstances, \nthen you should contact a reputable provider of insolvency services. \nSuch a provider can establish fairly quickly whether you are insolvent \nor not. If you are insolvent, then you should consider the full range of\n financial solutions. You could for example, petition for bankruptcy or \nenter an IVA or seek a Debt Relief Order (DRO). A DRO is limited to \ndebtors with disposable income of less than \u00a350 per month, debts of less\n than \u00a315,000 and no assets. If you confirm that you are not insolvent, \nit may be that you might better be able to address your financial \nproblems by for example, re-mortgaging your property and using the \nreleased equity to clear your debts or reduce them to manageable levels.<\/p>\n\n\n\n<p>A reputable provider of insolvency services will not charge you for \nadvice in relation to your options. Your current DMP company may well \nhave the expertise in house to review your circumstances and advise you \nappropriately. In any case, you may want a second opinion before you \ndecide to continue in your current DMP or to try an alternative \nsolution.
