{"id":1906,"date":"2014-01-02T11:06:38","date_gmt":"2014-01-02T11:06:38","guid":{"rendered":"https:\/\/www.nationaldebtrelief.co.uk\/debt-articles\/?p=1906"},"modified":"2019-02-12T11:15:18","modified_gmt":"2019-02-12T11:15:18","slug":"doing-an-iva-from-abroad","status":"publish","type":"post","link":"https:\/\/www.nationaldebtrelief.co.uk\/debt-articles\/doing-an-iva-from-abroad\/","title":{"rendered":"Doing an IVA from Abroad"},"content":{"rendered":"\n<h3 class=\"wp-block-heading\">If I <strong>live abroad<\/strong> and my <strong>debts<\/strong> are <strong>in the UK<\/strong> can I enter into an IVA?<\/h3>\n\n\n\n<p>The short answer to this question is \u2018<strong>YES<\/strong>, but\u2026!\u2019 The scope of the question is too broad to address fully in a short article.<\/p>\n\n\n\n<!--more-->\n\n\n\n<p>Let\u2019s limit the scope to the following criteria:<\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>All debts are to creditors in the UK.<\/li><li>The debtor lives in a country of the European Union other than the UK.<\/li><li>The debtor is insolvent.<\/li><li>An <strong>IVA<\/strong> in the UK is limited to <strong>England<\/strong>, <strong>Wales<\/strong> and <strong>Northern Ireland<\/strong>. For <strong>Scotland<\/strong> the broadly equivalent insolvency solution is a <strong>Trust Deed<\/strong>.<\/li><\/ol>\n\n\n\n<p>European regulations permit the insolvency legislation of one member  of the state to apply in another subject to certain provisos. The result  is that a debtor who now lives in another member state may be able to  put forward an IVA if the UK is considered their \u201ccentre of main  interests\u201d.<\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"alignleft is-resized\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.nationaldebtrelief.co.uk\/debt-articles\/wp-content\/uploads\/2019\/02\/Fotolia_1207017_M-1024x768.jpg\" alt=\"\" class=\"wp-image-1919\" width=\"251\" height=\"188\" srcset=\"https:\/\/www.nationaldebtrelief.co.uk\/debt-articles\/wp-content\/uploads\/2019\/02\/Fotolia_1207017_M-1024x768.jpg 1024w, https:\/\/www.nationaldebtrelief.co.uk\/debt-articles\/wp-content\/uploads\/2019\/02\/Fotolia_1207017_M-300x225.jpg 300w, https:\/\/www.nationaldebtrelief.co.uk\/debt-articles\/wp-content\/uploads\/2019\/02\/Fotolia_1207017_M-768x576.jpg 768w\" sizes=\"auto, (max-width: 251px) 100vw, 251px\" \/><\/figure><\/div>\n\n\n\n<p>A serving member of the Armed Forces for example who is serving \nabroad and who may be stationed abroad for long periods may enter into \nan IVA in the UK. The same may apply to anybody who is for example \nworking in a Member State but whose assets are located in the UK. \nSimilarly, anybody who works in the merchant navy may enter into an IVA,\n even though they may be abroad for much of their working lives, \nprovided their \u201ccentre of main interests\u201d is in the UK.<\/p>\n\n\n\n<p>Obviously there are many different scenarios which may impact on the \ndebtor\u2019s capacity to comply with the terms of an IVA. These could \ninclude assets held or acquired abroad or debts incurred abroad during \nor prior to the term of the proposed IVA. Nevertheless, creditors will \napprove such an IVA provided they are satisfied with the debtor\u2019s \ncapacity to comply with the terms.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>If I live abroad and my debts are in the UK can I enter into an IVA?
