You may also obtain an unsecured loan  and purchase a vehicle using the loan proceeds only or together with  cash of your own supplemented by the trade-in value of your own old  vehicle. <\/p>\n\n\n\n<!--more-->\n\n\n\n<p>Such an unsecured loan may be described in the loan documents as \u2018<strong>Credit Agreement Regulated by the Consumer Credit Act 1974<\/strong>\u2019 or \u2018<strong>Fixed Sum Loan Regulated by the Consumer Credit Act 1974<\/strong>\u2019.  Do not be fooled. Neither of these is a HP Agreement. However, if you  purchase a vehicle using any of the above means, the vehicle is now your  property. <\/p>\n\n\n\n<p>An alternative means of acquiring a vehicle is via a <strong>Hire Purchase Agreement<\/strong>.\n A vehicle acquired in this way is not your property \u2013 at least not yet.\n The words \u2018Hire Purchase Agreement\u2019 simply means that you have entered \ninto an agreement to hire the vehicle with an option to purchase. \nAccordingly you do not have the right to sell on such a vehicle. You may\n have paid a deposit or traded in your own vehicle as part of the Hire \nPurchase Agreement but that does not make you the owner of the vehicle.<\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"alignleft is-resized\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.nationaldebtrelief.co.uk\/debt-articles\/wp-content\/uploads\/2019\/02\/Fotolia_65093460_XS.jpg\" alt=\"Car Hire Purchase\" class=\"wp-image-2381\" width=\"366\" height=\"244\" srcset=\"https:\/\/www.nationaldebtrelief.co.uk\/debt-articles\/wp-content\/uploads\/2019\/02\/Fotolia_65093460_XS.jpg 424w, https:\/\/www.nationaldebtrelief.co.uk\/debt-articles\/wp-content\/uploads\/2019\/02\/Fotolia_65093460_XS-300x200.jpg 300w\" sizes=\"auto, (max-width: 366px) 100vw, 366px\" \/><\/figure><\/div>\n\n\n\n<p>When acquiring a vehicle it is important to distinguish between an \nunsecured loan and a HP Agreement. The first step is to ask whoever is \nfinancing the deal which it is. If you are being offered a HP Agreement,\n you will have an opportunity to examine the contract documents. It \nsounds too easy but the documents will normally be entitled \u2018HIRE \nPURCHASE AGREEMENT REGULATED BY THE CONSUMER CREDIT ACT 1974\u2019. An \nalternative title used in HP Agreement documents is \u2018CONDITIONAL SALE \nAGREEMENT REGULATED BY THE CONSUMER CREDIT ACT 1974\u2019. These are both \nacceptable titles.<\/p>\n\n\n\n<p>If you want to be doubly sure, check the text of the HP agreement. \nThe text of the agreement should include a section entitled TERMINATION:\n YOUR RIGHTS\u2019. This section confirms that you have a right to end the \nagreement and explains how you should go about doing so, if that is what\n you want to do.&nbsp; Furthermore, the text of a valid HP Agreement should \nalso include a section entitled \u2018REPOSSESSION: YOUR RIGHTS\u2019. This \nsection explains your rights in the event that the HP provider wishes to\n repossess the vehicle. There are other standard sections in a valid HP \nAgreement and if the agreement in front of you ticks all the boxes \nabove, then it is highly likely that that is what it is. You will not \nbecome the owner of a vehicle acquired under a Hire Purchase Agreement \nuntil you have paid all the installments due under the agreement and \nexercised your \u2018option to purchase\u2019 right at the end of the term of the \nagreement.<\/p>\n\n\n\n<p>In the event that you enter into an Individual Voluntary Arrangement \nwith your creditors, you will have to continue to pay the full amount of\n the monthly HP premium. As a secured liability, the HP agreement is \nsimilar to a mortgage in that respect. The HP debt cannot be entered \ninto the IVA unless you default on your HP payments. In such a scenario,\n the HP provider would repossess the vehicle (according you your due \nrights under the agreement) and any shortfall would be entered into your\n IVA as an unsecured debt. At that point it would rank for dividend \nequally with all your other unsecured liabilities.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A vehicle may be purchased for cash or by trading in your old vehicle and paying the balance in cash.
