{"id":2795,"date":"2014-01-10T15:27:19","date_gmt":"2014-01-10T15:27:19","guid":{"rendered":"https:\/\/www.nationaldebtrelief.co.uk\/debt-articles\/?p=2795"},"modified":"2020-10-20T15:26:00","modified_gmt":"2020-10-20T14:26:00","slug":"iva-or-bankruptcy-pt6","status":"publish","type":"post","link":"https:\/\/www.nationaldebtrelief.co.uk\/debt-articles\/iva-or-bankruptcy-pt6\/","title":{"rendered":"IVA or Bankruptcy &#8211; Part 6"},"content":{"rendered":"\n<p>In the first five articles in this series, we looked at the possible \neffects of insolvency on the careers of those engaged in a variety of \nprofessions: accountants, members of the police and of the armed forces,\n members of the medical, dental, veterinary &amp; pharmaceutical \nprofessions and those engaged in the practice and administration of law.<\/p>\n\n\n\n<!--more-->\n\n\n\n<p>It might come as a surprise to some that there is a whole range of  additional professions which may be affected by insolvency. Many of the  Recognized Professional Bodies (RPBs) governing professions have their  own rules and regulations in regard to a member becoming insolvent and  these may be revised from time to time. Furthermore, the attitude of any  particular RPB and its standard practice in dealing with an insolvent  member may also vary somewhat depending on a number of factors. The most  serious sanctions applied range from mandatory expulsion to  discretionary expulsion from the RPB and possible loss of licence or  accreditation. Such a sanction might mean loss of livelihood for the  professional.<\/p>\n\n\n\n<p>Professions which may be affected include: approved driving \ninstructor, architects, holders of consumer credit licences, members of \nthe IPA, local government councillors, members of parliament, estate \nagents, holders of operator\u2019s licences for HGV or PSV, school governors,\n trustees of charities and trustees of pension schemes and others.<\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"alignleft is-resized\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.nationaldebtrelief.co.uk\/debt-articles\/wp-content\/uploads\/2019\/02\/Fotolia_44371274_XS.jpg\" alt=\"Architect Debt\n\" class=\"wp-image-2812\" width=\"359\" height=\"269\" srcset=\"https:\/\/www.nationaldebtrelief.co.uk\/debt-articles\/wp-content\/uploads\/2019\/02\/Fotolia_44371274_XS.jpg 400w, https:\/\/www.nationaldebtrelief.co.uk\/debt-articles\/wp-content\/uploads\/2019\/02\/Fotolia_44371274_XS-300x225.jpg 300w\" sizes=\"auto, (max-width: 359px) 100vw, 359px\" \/><\/figure><\/div>\n\n\n\n<p>The relevant RPB may implement a variety of mandatory and \ndiscretionary sanctions when a member becomes insolvent and either opts \nfor Bankruptcy or enters into an Individual Voluntary Arrangement (IVA).\n In an ideal world the potentially insolvent professional could check \ndirectly with his or her RPB to determine such effects but many \nprofessionals would be understandably reluctant to do so, lest their \nquestions alert their RPB to the situation prematurely. A reputable \nInsolvency Practitioner (IP) could however elicit such detailed \ninformation from the RPB on a confidential and anonymous basis on behalf\n of a professional client who is insolvent or is likely to become so.<\/p>\n\n\n\n<p>If not already a member, anyone applying to join an RPB governing \ntheir profession should disclose significant issues relating to their \nfinancial status, particularly if insolvent or likely to become so.&nbsp; \nBetter to address such issues up front than to have to deal with them \nafter joining the RPB as failure to disclose may incline the RPB to \nexercise its discretionary powers of sanction. Anyone who is already a \nmember of an RPB and is threatened with insolvency should familiarize \nthemselves with the rules and regulations of the RPB and try to \ndetermine its attitude and standard practice in these matters.<\/p>\n\n\n\n<p>If the RPB maintains a benevolent fund for members, an insolvent \nmember could consider consulting with its trustees but before doing so \nshould consider taking independent legal advice before making what could\n turn out to be a career threatening decision. A reputable insolvency \npractitioner will also provide invaluable advice on all the available \noptions open to an insolvent professional. Such advice should be \nprovided free of charge.
