{"id":487,"date":"2013-12-12T13:01:23","date_gmt":"2013-12-12T13:01:23","guid":{"rendered":"https:\/\/www.nationaldebtrelief.co.uk\/debt-articles\/?p=487"},"modified":"2020-10-20T10:12:55","modified_gmt":"2020-10-20T09:12:55","slug":"iva-fees","status":"publish","type":"post","link":"https:\/\/www.nationaldebtrelief.co.uk\/debt-articles\/iva-fees\/","title":{"rendered":"IVA Fees"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\">Affording the fees in an IVA<\/h2>\n\n\n\n<p>A major concern for many people who become insolvent and are considering entering into <a href=\"https:\/\/www.nationaldebtrelief.co.uk\/debt-help\/iva.html\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">an IVA<\/a>  is whether they can afford the fees incurred in the process. <\/p>\n\n\n\n<!--more-->\n\n\n\n<p>This is an  understandable concern but it should not really be a worry. If  the firm providing the insolvency service is worth its salt then this  particular concern can be put to bed quickly and assuredly.<\/p>\n\n\n\n<p>In the first instance it is really the creditors who pay the fees  since the monies which the insolvent debtor contributes to the IVA is  repayment of (part of) the debt which the debtor has incurred with his  or her creditors. Let us call these contributions <strong>\u2018the IVA fund\u2019<\/strong>.  The fees of the IVA are paid from this fund. In relation to the payment  of fees, let us look at the role of the Insolvency Practitioner or the  IP. The IP is called the Nominee up to the time when the IVA is approved  (or rejected) at the Meeting of Creditors and after that the IP is  called the Supervisor. These are simply the terms used in the  legislation and reflect the fact that the role of the IP changes  somewhat between the time when the IVA proposals are offered to  creditors and the time when the proposals are accepted. In fact legally  the Nominee IP need not be the same person as the Supervisor IP although  generally they are the same person.<\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"alignleft is-resized\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.nationaldebtrelief.co.uk\/debt-articles\/wp-content\/uploads\/2019\/01\/Fotolia_54918574_XS.jpg\" alt=\"IVA Fees\" class=\"wp-image-517\" width=\"299\" height=\"226\" srcset=\"https:\/\/www.nationaldebtrelief.co.uk\/debt-articles\/wp-content\/uploads\/2019\/01\/Fotolia_54918574_XS.jpg 399w, https:\/\/www.nationaldebtrelief.co.uk\/debt-articles\/wp-content\/uploads\/2019\/01\/Fotolia_54918574_XS-300x226.jpg 300w\" sizes=\"auto, (max-width: 299px) 100vw, 299px\" \/><\/figure><\/div>\n\n\n\n<p>The Supervisor IP receives the contributions from the debtor over the\n life of the IVA and is responsible for controlling the fund and making \npayments from it. These payments can be broadly broken down into three \ntypes: dividends to creditors; fees payable to the IP (Nominee &amp; \nSupervisor) and disbursements such as the cost of registration of the \nIVA, insurance and VAT on transactions.<\/p>\n\n\n\n<p>The amounts of the IP fees are not arbitrary. These have already been\n set when the Meeting of Creditors approved the IVA in the first place. \nMore than 75% of the creditors had to agree to these fees. The usual \npractice is the IVA proposal carries the details of the fees and costs \nand the creditors may amend these, by way of modifications to the IVA, \nif they think they are too high.<br>\nThe IP may not charge more than the agreed amounts without the express \npermission of the creditors (again more than 75%&nbsp; of creditors, as \nmeasured by the value of the debts, have to agree) even where the work \nof supervising the IVA turns out to be more extensive and costly than \noriginally anticipated.
