If your debts are out of your \ncontrol and you simply can no longer keep up with them, there are a few \noptions worth considering, and an IVA or Individual Voluntary \nArrangement is certainly one of them.<\/p>\n\n\n\n<!--more-->\n\n\n\n<p>In many cases, people opt for <strong>IVAs to avoid bankruptcy<\/strong>,\n in that they do indeed help many people to get back on top of their \ndebts in a manageable way. Your own circumstances will dictate not only \nwhat your options are, but also what\u2019s likely to land you in better \nfinancial health in the future.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Debt Help<\/h2>\n\n\n\n<p>Getting expert advice is really the best way to establish what your best option is. <strong>Insolvency Practitioners<\/strong> or <strong>IP\u2019s<\/strong>\n can take a look at your overall financial state, and advise you as to \nwhich way to move. They will take into account your assets, your income \nand of course your total debts. An IVA \nshould generally not be seen as a way of avoiding having to pay your \ndebts, as what it is in reality is a way to come to an agreement between\n you and your creditors to work those debts out.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Legal matters<\/h2>\n\n\n\n<p>When you can\u2019t keep up with your debts there are a number of things \nyou can do. One of these is to attempt to come to an informal agreement \nwith your individual creditors, agreeing to make payments that you can \nactually afford. This can be a difficult process, and you\u2019re really at \nthe mercy of the creditors who will ultimately decide whether to \nnegotiate with you or not. In some cases your creditors may choose to \npursue you for the debts through the legal system, which can have some \nserious consequences.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Protection<\/h2>\n\n\n\n<p>One of the advantages to an IVA, is that if your creditors agree to \nit, it prevents them from taking further legal action against you for \nthe debts involved, as long as you keep to the IVA payments. The IVA is a\n legally binding contract between you and the creditors, and so you get a\n certain security as a result.<\/p>\n\n\n\n<p>Naturally, whoever you owe debt to will receive fewer funds back from\n you through an IVA than whatever you\u2019ve agreed to as per your credit \nagreements. However, if you cannot meet these agreements, and there is a\n chance you will end up bankrupt, then they will receive even less back \nultimately.
